Terms of Service

These terms apply when you buy from, or use, https://vascodagamaperiperi.com. By placing an order you agree to these terms and to our Shipping Policy, Refund Policy, Privacy Policy and Food Safety and Allergen page, which all form part of the agreement between us.

1. Who we are

The website is operated by Vasco Da Gama Peri Peri (Pty) Ltd, registration number 2013/119496/07, VAT number 4280324940. Our physical and postal address is Unit 10, 240 Vonkprop Road, Samcor Park, Pretoria, Gauteng 0184. You can reach us at office@vascodagamaperiperi.com or +27 71 342 8860. Our products are manufactured in a HACCP-compliant facility in Gauteng. This information is provided in line with section 43 of the Electronic Communications and Transactions Act 25 of 2002 (ECTA).

2. What we sell and who may buy

We sell shelf-stable sauces (peri peri, hot and chilli sauces), spice blends, pickled jalapenos and 5L catering sauces to retail customers and to trade customers such as butcheries, caterers and restaurants. You must be 18 or older to order. If you order for a business, you confirm that you are authorised to do so.

3. Placing an order

  • You can review and correct your order before you submit it at checkout.
  • Your order is an offer to buy. We accept it when we dispatch the goods or confirm that they are ready for collection. An automated order confirmation is not acceptance.
  • We may decline or cancel an order if stock is unavailable, a price or description on the site was clearly wrong, payment does not clear, or we suspect fraud. If you have already paid, we will refund you in full.
  • Product images are for illustration. Colour and consistency of natural products may vary slightly between batches.

4. Prices, VAT and invoices

Prices are in South African Rand and include VAT at 15%. Delivery charges are shown separately at checkout. Price changes do not affect an order we have already accepted. A tax invoice is issued for every order. Wholesale prices apply only to the case-pack quantities shown on the site.

5. Payment

  • Card: processed securely by Yoco. We do not see or store your card number.
  • EFT: use your order number as the payment reference. We dispatch or release for collection once the funds reflect in our account. If payment has not reflected within 5 working days of the order date, we may cancel the order and release the stock. You are welcome to reorder.

6. Delivery and collection

Delivery is by Bob Go couriers within South Africa only, or free collection from our factory Monday to Friday 08:00 to 16:00. Rates, delivery times and the damaged-in-transit procedure are in the Shipping Policy. Under section 19 of the Consumer Protection Act 68 of 2008 (CPA), goods remain at our risk until you or your representative accept delivery.

7. Wholesale, case-pack and pre-order items

  • Wholesale and case-pack products are sold in the fixed pack sizes shown. We cannot split cases.
  • Pre-order items show a lead time on the product page, which starts once payment has reflected. We will tell you promptly if it changes, and you may cancel for a full refund if the delay is unreasonable.
  • Trade customers are responsible for storing, handling and labelling the products correctly in their own business and for complying with laws that apply to their onward sale.

8. Cooling-off and returns

The 7-day cooling-off right in section 44 of ECTA does not apply to foodstuffs delivered to your home or workplace, and the CPA cooling-off right in section 16 applies only to sales that result from direct marketing, not to orders you place yourself on our website. Your rights if goods are defective, damaged, spoiled, wrong or short-delivered are fully protected and explained in our Refund Policy, which also sets the conditions for any change-of-mind return.

9. Food safety, allergens and correct use

Our products contain chilli and some contain allergens, including gluten, soya, egg, mustard and sulphites. Ingredient and allergen information appears on each product page and label, in line with the Foodstuffs, Cosmetics and Disinfectants Act 54 of 1972 and its labelling regulations (R146). You agree to read the label before use, to store the product as instructed (ambient before opening, refrigerated after opening) and to follow the Food Safety and Allergen page. Nothing on our site is medical advice. If you are unsure whether a product is suitable for you, consult a healthcare professional.

10. Our responsibility to you

We stand behind the quality of our products. We do not exclude or limit any liability that the law does not allow us to exclude, including our liability under section 61 of the CPA for harm caused by unsafe or defective goods and the implied warranty of quality in sections 55 and 56 of the CPA. Subject to that, and to the extent the law permits, we are not responsible for loss caused by failure to follow storage, use or allergen instructions, by misuse or alteration of a product, by incorrect information you gave us, or for indirect losses such as loss of profit in a trade customer's business. Where the law allows us to limit our liability, it is limited to the price you paid for the affected order.

11. Website use and intellectual property

Our name, logos, images and text belong to us and may not be copied or used commercially without our written permission, except that trade customers may use our product images and names, unaltered, to advertise products they buy from us. You may not use the site unlawfully or attempt to gain unauthorised access to it. We try to keep the site accurate and available but cannot promise it will be error-free.

12. Events beyond our control

We are not in breach of these terms if we are delayed or prevented from performing by events beyond our reasonable control, such as strikes, courier failures, power or water outages, fires, floods, pandemics, government action or supplier failures. We will tell you and do what we reasonably can to reduce the delay. If an order cannot be fulfilled within a reasonable time, either of us may cancel it and we will refund what you paid.

13. Privacy

We process personal information in line with the Protection of Personal Information Act 4 of 2013 and our Privacy Policy.

14. Complaints, disputes and governing law

If something goes wrong, contact us first at office@vascodagamaperiperi.com or +27 71 342 8860 so that we can put it right. If we cannot resolve the matter, you may refer it to the Consumer Goods and Services Ombud (www.cgso.org.za, 0860 000 272) or the National Consumer Commission (www.thencc.gov.za). These terms are governed by South African law and the South African courts have jurisdiction. Nothing in these terms limits your rights under the CPA or any other law.

15. Changes to these terms

We may update these terms from time to time. The version shown on the site when you place your order applies to that order.
